GOP establishment leader Kevin McCarthy has failed to reach the 218 votes he needs to become Speaker of the House, with Freedom Caucus members making good on their promise to oppose his speakership campaign.

After party boss, Elise Stefanik nominated Kevin McCarthy, America First Rep. Paul Gosar stood to nominate his fellow Freedom Caucus conservative and Arizonan, Rep. Andy Biggs for speaker, setting off a chain of events that has knocked McCarthy’s speakership campaign flat on its back in the first round of voting.

After the nomination, Rep. Biggs became the first Republican to oppose McCarthy’s nomination, voting for himself before Colorado Rep. Lauren Boebert voted for Jim Jordan.

As the votes continue, conservative Republicans are standing up to McCarthy, who used FTX cash and his political machine to crush America First candidates in the 2022 midterms.

In a last-ditch effort to whip Republicans into line, McCarthy threatened to kick all those opposed to his speakership campaign off of their committee assignments. This threat was confirmed to National File first-hand by a Freedom Caucus member on their way into the speakership vote.

This threat appears to have fallen on the firmly entrenched ears of Reps. who are refusing to let McCarthy become Speaker of the House.

Among those voting in favor of McCarthy is Georgia Rep. Marjorie Taylor Greene.

As if the end of the first vote, 19 Republicans in total have voted against McCarthy, putting the speakership well out of his reach.

Club for Growth has come out in opposition to Kevin McCarthy’s campaign for Speaker of the House, on the eve of January 3rd’s leadership vote. McCarthy, who is facing stiff opposition from House conservatives and Freedom Caucus members, needs 218 votes to secure the speakership, a level of support that he appears to be drifting further and further away from.

“The Club for Growth urges all Representatives to vote for a Speaker of the House of Representatives that will provide transformational reforms to the House, build a bold pro-growth legislative agenda, and restore the individual rights and powers of the rank-and-file membership,” the group’s statement reads.

Under the current requirements, Kevin McCarthy is disqualified, considering his support for keeping Nancy Pelosi’s House rules, which empower party bosses and ice the people’s representatives out of the legislative process.

“If a candidate for Speaker refuses to support and adopt the reforms outlined below – Club for Growth urges all Representatives to vote against that candidate for Speaker,” the statement goes on.

As things currently stand, Kevin McCarthy is well short of the 218 votes required to become Speaker of the House, as conservative representatives have lined up to oppose him, based not only on his affection for Nancy Pelosi’s House rules but his long career within the GOP establishment as well.

At the crux of the Pelosi rules debate has been the Democrat House Speaker’s removal of the motion to vacate the chair, a more than two-century-old parliamentary procedure empowering representatives to oust an ineffective or lousy Speaker of the House.

This rule was gutted by Pelosi, and the power to remove the Speaker of the House is now in the hands of party bosses.

Club for Growth’s opposition to McCarthy’s speakership campaign and Pelosi’s House rules comes as members of the conservative House Freedom Caucus are publicly vowing to vote against McCarthy.

Recently, reports have emerged that McCarthy is attempting to negotiate with Freedom Caucus members to win their support, but he still refuses to get rid of Nancy Pelosi’s rules.

Kevin McCarthy, with the help of CNN, has attempted his last-ditch effort to try to seize Nancy Pelosi’s gavel and claim the long-pined-for title of U.S. House Speaker.

In a report made public by CNN’s Melanie Zanona just ahead of New Year’s Eve, the China-aligned TV network carried heavy water in the effort to try to convince readers, and particularly the conservative House Freedom Caucus, that McCarthy is actually negotiating in good faith with the Republican Conference.

Kevin’s last-gasp attempt to win the speakership is seen by many Republican House members as a “Hail Mary,” according to multiple interviews National File has conducted with members of the U.S. House.

“Heil NANCY is more like it,” said one Republican lawmaker.

“McCarthy offers his critics a key concession in effort to clinch House speakership,” CNN’s headline reads.

Thankfully, most of the handful of CNN’s audience — and even some conservatives who saw the fictional story tweeted out, reacted negatively to the prospect of a McCarthy speakership.

“The historic rule allowed one member to file the motion to vacate. Pelosi radically changed it,” a senior Hill staffer told National File.

“The freedom caucus wanted the historic rule reimposed but McCarthy has submitted a compromise effort at 5 members. The Republicans are dead set against keeping any part of Pelosi’s rule”

So where did Zanona and CNN go wrong?

Predictably, Zanona’s article neglected to mention that the offer McCarthy actually endeavored to keep a major measure of Nancy Pelosi’s House Rules.

At issue is the critical “Motion to Vacate the Chair,” a parliamentary rule that has been in place since Thomas Jefferson’s time, that allows a single member of the House to introduce the topic of a fifty-fifty up or down vote on the tenure of the occupant of the “chair” — The Speaker of the House.

Zanona neglected to include the fact that a single member could file the motion, but that it would not be privileged — meaning, that any Member can offer such a motion at any time and is subject to an immediate vote. Effectively, that means Pelosi and Steny Hoyer’s Rules Package took away autonomy from the Democrat conference to remove her.

Instead of covering this particular rule, Zanona attempted to gaslight CNN’s audience by convincing them that McCarthy was doing House conservatives a favor by reducing the number required to file the motion from fifty — a fictional number, which has never been in place under Republican majority — to five members.

A requirement of five members to file the motion to remove the House Speaker is 500% greater than the number required previously, when Donald Trump was President and Paul Ryan was the House Speaker.

Zanona’s CNN piece reads as follows:

One of the numbers that has come up in recent conversations between McCarthy and GOP lawmakers – and which has not been previously reported – is a five-person threshold, according to two of the Republican sources.

Zanona continues on to blatantly misrepresent the particulars around how the “Motion to Vacate the Chair” actually works.

Currently, the majority of the House GOP is required to call for the so-called motion to vacate the speaker’s chair.

This is not accurate.

Currently, with Pelosi as House Speaker, no number of GOP members could successfully file the Motion to Vacate the Chair.

Either Zanona and CNN are ignorant of a blatantly simple parliamentary procedure that requires simple “greater than or less than” mathematics to interpret, or Zanona and CNN have chosen to blatantly lie to their readers about a key House Rule that provides accountability for the leader of the majority party in the U.S. House.

Whether this lie was orchestrated in concert with Kevin McCarthy’s office or whether Zanona stuck out on her own with the imprimatur of CNN in order to mislead the public is unclear.

National File has reached out to Zanona, and spoke with her briefly by phone, but she declined to comment about her misrepresentation of the House Rules.

After setting her lynchpin to lie down, Zanona’s report continues:

But some conservative hardliners are pushing for a single member to be able to call for such a vote, which they see as an important mechanism to hold the speaker accountable.

A five-person threshold, however, may be too low for the moderate wing of the party, some of whom have privately suggested they would be willing to agree on a 50-person threshold.

And some of McCarthy’s fiercest critics, including Reps. Matt Gaetz of Florida and Ralph Norman of South Carolina, told CNN they see the five-person threshold as still too high, underscoring the significant challenge McCarthy faces as he works to lock down the speakership.

“No, less than 5!!” Norman said in a text message of the proposed motion to vacate threshold. “2 or less (my opinion).”

And Gaetz said: “He’s gotta get down to 1.”

Getting rid of Nancy Pelosi’s House Rules by returning the vital rule known as “The Motion to Vacate the Chair” is widely recognized as the key sticking point for conservatives in the House, including many members of the House Freedom Caucus.

CNN is forced to recognize the same.

As Zanona writes,

A compromise on the motion to vacate – which McCarthy previously said he would not budge on – could be key to unlocking the votes he needs to secure the speakership. And his willingness to negotiate on the issue also shows how desperate McCarthy is to seal the deal, even if it means giving away some of his power.

The last bait-and-switch McCarthy tried to pull in an effort to keep Nancy Pelosi’s House Rules was the minimum vote required to approve the Motion to Vacate the Chair.

As National File reported:

Establishment-leaning members of the House Freedom Caucus are considering a compromise to make Kevin McCarthy the next Speaker of the House; a compromise that involves keeping Nancy Pelosi’s rules, while adding a watered-down version of the crucial motion to vacate the chair.

Under the compromise being considered by some Freedom Caucus members, to come over to the side of establishment leader Kevin McCarthy, a two-thirds majority will be required to “vacate” the position of speaker.

McCarthy has seemingly scrapped his effort to keep the two-thirds requirement, and has opted instead to try to slip the 5 members to file requirement by the watchmen.

Guideline G: Alchohol Consumption:

1.    The Concern. Excessive alcohol consumption often leads to the exercise of questionable judgment or the failure to control impulses, and can raise questions about an individual’s reliability and trustworthiness.

2.    Conditions that could raise a security concern and may be disqualifying include:

(a)  alcohol-related incidents away from work, such as driving while under the influence, fighting, child or spouse abuse, disturbing the peace, or other incidents of concern, regardless of the frequency of the individual’s alcohol use or whether the individual has been diagnosed with alcohol use disorder;

(b) alcohol-related incidents at work, such as reporting for work or duty in an intoxicated or impaired condition, drinking on the job, or jeopardizing the welfare and safety of others, regardless of whether the individual is diagnosed with alcohol use disorder;

(c)  habitual or binge consumption of alcohol to the point of impaired judgment, regardless of whether the individual is diagnosed with alcohol use disorder;

(d)  diagnosis by a duly qualified medical or mental health professional (e.g., physician, clinical psychologist, psychiatrist, or licensed clinical social worker) of alcohol use disorder;

(e)  the failure to follow treatment advice once diagnosed;

(f)  alcohol consumption, which is not in accordance with treatment recommendations, after a diagnosis of alcohol use disorder; and

(g) failure to follow any court order regarding alcohol education, evaluation, treatment, or abstinence.

Freedom Caucus Rep. Matt Gaetz came out swinging against establishment leader Kevin McCarthy in a War Room interview with Steve Bannon, renewing his vow to oppose McCarthy’s speakership campaign and calling his political career a “puppet show” that’s done nothing but serve his own interests and ambitions.

Kevin McCarthy failed to make good on his promise of a “red wave” election in 2022, with the GOP only winning a razor-thin majority of seats, despite blowing Democrats out in the popular vote nationwide. This is thanks to McCarthy’s strategic targeting of conservative House candidates with FTX money and other deep state funds, in order to protect establishment incumbents in both parties.

“That’s not winning,” Gaetz said. “That’s fumbling the ball at the goal line and somehow ending up well below projections.”

While supporters of McCarthy’s speakership campaign, which appears doomed to fail on January 3rd, claim he’s “moved to the right,” Gaetz told Steve Bannon that McCarthy’s supposed embrace of MAGA policy is nothing more than a “puppet show.”

“It’s not real,” said Gaetz. “It’s fiction.”

“If you look at the entire body of work of Kevin McCarthy, it is a trajectory of slow surrender,” Gaetz added, blasting McCarthy’s failures to stand up to Democrats year after year, Congress after Congress.

“If McCarthy got the gavel, and I don’t think he will, the only thing he would be focused on would be growing the majority so he didn’t have to deal with firebrands like me and he would do anything, violate any commitment, in service of that objective, his entire career proves it,” said Rep. Gaetz.

Adding that a “phoenix” will “rise from the ashes” of McCarthy’s doomed speakership campaign to lead an America First Congress, that will affect meaningful change and send radical Democrats on the run.

Under a McCarthy speakership, Gaetz detailed, the “slow surrender” of America would continue.

“On none of the problems we’ve talked about could we anticipate any solutions from Kevin McCarthy,” said Rep. Gaetz.

“What Kevin’s going to do, is he’s going to, in theory, pass a bunch of messaging bills that will die in the Senate.”

“This is about leverage. Utilizing points of leverage throughout the next two years to deliver tangible wins for our people and to highlight the corrupt, criminal, illegitimate features of this administration currently in power,” said Rep. Gaetz.

“That’s the game. And Kevin McCarthy doesn’t have that club in the bag.”

“He is not someone who has ever supported rigorous oversight in the past. In fact, when [McCarthy ally Paul] Ryan was Speaker and Kevin McCarthy was the Majority Leader, he never piped up when we were seeking subpoenas to try to stop the FBI and the Deep State from de-stabilizing the presidency and the country.”

“I’ve seen enough from this guy,” Gaetz said.

The Florida conservative went on to detail the ongoing negotiations between McCarthy and Freedom Caucus legislators, who are demanding a return of the crucial motion to vacate the chair. The motion, which empowers members of Congress to vote a bad Speaker out, was gutted by the left-wing Pelosi House rules that McCarthy intends to keep.

Rep. Gaetz said that the motion to vacate is critical because McCarthy “isn’t a leader” and can’t be trusted.

“He has offered everything he has ever thought to offer and everything we have ever thought to ask for and it still isn’t enough because the man isn’t a leader.”

“There’s a reason why the motion to vacate matters…it is a necessary feature if you don’t trust someone,” Gaetz said.

“We know that with Kevin McCarthy, the lies always change.”

His own mentor gave an interview […] and said…’with Kevin, he will always lie, the lie will always change, and the lie is always in service of one thing; his ambition.'”

“I don’t really view Kevin as [being] to the right or to the left,” Gaetz added. “He’s a political amoeba, willing to float anywhere and take any shape or form, so long as it fits that particular moment.”

The Concern. Failure to live within one’s means, satisfy debts, and meet financial obligations may indicate poor self-control, lack of judgment, or unwillingness to abide by rules and regulations, all of which can raise questions about an individual’s reliability, trustworthiness, and ability to protect classified or sensitive information. Financial distress can also be caused or exacerbated by, and thus can be a possible indicator of, other issues of personnel security concern such as excessive gambling, mental health conditions, substance misuse, or alcohol abuse or dependence. An individual who is financially overextended is at greater risk of having to engage in illegal or otherwise questionable acts to generate funds. Affluence that cannot be explained by known sources of income is also a security concern insofar as it may result from criminal activity, including espionage.

Conditions that could raise a security concern and may be disqualifying include:

(a) inability to satisfy debts;

While there is limited evidence of personal inability to satisfy debts, there is a growing concern that his decisions on the house floor create an environment that forces the nation into an inability to satisfy its own debts and thus giving other nations such as China leverage over the United States and its citizens. It places the Country in a compromising position. Additionally, Minority Leader Kevin McCarthy oversaw 9 of his republican conference to vote for increasing the U.S. Debt by yet another $1.7 Trillion dollars. Reps. John Katko (R-NY), Chris Jacobs (R-NY), Brian Fitzpatrick (R-PA), Fred Upton (R-MI), Rodney Davis (R-IL), Jaime Herrera Beutler (R-WA), Steve Womack (R-AR), Adam Kinzinger (R-IL), and Liz Cheney (R-WY);

(b) unwillingness to satisfy debts regardless of the ability to do so;

(c) a history of not meeting financial obligations;

Votes in the House show that he is unwilling to be a responsible steward of taxpayer funds. We continue to investigate Kevin McCarthy’s personal finances to determine if there is a heightened risk under this adjudicative guideline.

(d) deceptive or illegal financial practices such as embezzlementemployee theft, check fraud, expense account fraud, mortgage fraud, filing deceptive loan statements, and other intentional financial breaches of trust;

(e) consistent spending beyond one’s means or frivolous or irresponsible spending, which may be indicated by excessive indebtedness, significant negative cash flow, a history of late payments or of non-payment, or other negative financial indicators;

This transgression would apply to his role as a member of Congress who lead a party that allowed for the above to take place on behalf of the nation due to weakness in resolve and likely compromise himself as outlined in previous adjudicative guidelines.

(f) failure to file or fraudulently filing annual Federal, state, or local income tax returns or failure to pay annual Federal, state, or local income tax as required;

No evidence was found, however, one incoming House Member, George Santos may be subject to this transgression and is actively supporting McCarthy to be the next Speaker of the House. Further investigation may lead to nefarious or improper funds between the two. Should there be an update, we will amend this adjudicative guideline.

(g) unexplained affluence, as shown by a lifestyle or standard of living, increase in net worth, or money transfers that are inconsistent with known legal sources of income;

(h) borrowing money or engaging in significant financial transactions to fund gambling or pay gambling debts; and

(i) concealing gambling losses, family conflict, or other problems caused by gambling.

VERDICT: Kevin McCarthy’s counterintelligence risk of Financial Considerations has thus far resulted in limited direct evidence to support an unfavorable adjudication. However, we continue to monitor if any money potentially received by him, his campaign and associated Political Action Committees was from Ukraine corrupted FTX depositors/executives. Additionally, we will continue to monitor if these money flows could have created a significant conflict of interest or complicity in potential fraud if it was known this money was corrupted and may have placed him in a conflict of interest. Absent further evidence to support and substantiate personal use of these monies, we currently determine that there is a low-moderate level risk, but requires continued monitoring. US Representative-elect Anna Paulina Luna has come out against Kevin McCarthy’s campaign for Speaker of the House in a public statement to the constituents of Florida’s 13th Congressional District. In it, she issued a 5-point list of priorities that she says any GOP Speaker candidate should have, including a scrapping of Nancy Pelosi’s House rules, the return of the motion to vacate, and a commitment not to use dark money to railroad conservative candidates in GOP primaries, as McCarthy did in 2022.

Luna, a conservative Rep-elect from Florida’s Pinellas County-based 13th District, issued a public statement to her constituents this month, laying out her requirements for a Speaker candidate. The list echoed the demands of Freedom Caucus Reps, like Bob Good and Matt Gaetz, who’ve also publicly come out against McCarthy’s speakership campaign.

Ahead of the January 3rd vote for Speaker, McCarthy has failed to garner enough support to secure the 218 votes he needs, after previously falling short in an internal GOP vote. According to his conservative opponents and estimates based on the public statements of Representatives, McCarthy could need as many as 25 Democrat votes to become Speaker of the House.

Luna called for a return of the crucial motion to vacate the chair, which was stripped away in Nancy Pelosi’s House rules packages. Without it, members of Congress are powerless to hold the Speaker accountable, and Kevin McCarthy has refused to commit to bringing the motion back.

The motion to vacate, “stood the test of time for 200 years, starting with Thomas Jefferson,” Luna’s statement reads, before explaining that without it, Pelosi has been able to “exercise total control,” as members of Congress are powerless to stop her.

Luna also called for the “fair treatment” of all members of Congress, and an end to the Pelosi-era practice of icing the American people and their elected Representatives out of the legislative process, by concentrating power among party leadership, and a “clear policy agenda” to reign in government spending.

She also called out Kevin McCarthy’s meddling in GOP primaries, like that of Laura Loomer in Luna’s home state of Florida, a race in which Kevin McCarthy and his political machine spent dark money from the corrupt FTX crypto exchange to sabotage the conservative challenger to an establishment incumbent.

A suitable Speaker candidate must make “a commitment to staying neutral in Republican primaries, including financially, through 3rd parties and allied groups,” Luna’s statement reads, before also calling for conservative representation on the all-important Rules Committee.

“I will only vote for a Speaker candidate who embraces these changes,” the statement goes on, effectively ruling McCarthy out altogether.

Of special interest is any failure to cooperate or provide truthful and candid answers during national security investigative or adjudicative processes. The following will normally result in an unfavorable national security eligibility determination, security clearance action, or cancellation of further processing for national security eligibility.

(a) refusal, or failure without reasonable cause, to undergo or cooperate with security processing, and

(b) refusal to provide full, frank, and truthful answers to lawful questions of investigators or other official representatives in connection with a personnel security or trustworthiness determination.

-Kevin McCarthy has failed since 2015 to address the original concern by Congressman Walter Jones that was raised regarding why McCarthy dropped out of the race for the Speaker of the House. Essentially trying to ignore and divert attention from an alleged affair with fellow Congresswoman Renee Ellmers.

Conditions that could raise a security concern and may be disqualifying include:

(a) deliberate omission, concealmentor falsification of relevant facts, personal history statement, or similar form used to conduct investigations, determine employment qualifications, determine national security eligibility or trustworthiness, or award fiduciary responsibilities;

Since the US Constitution in Article I, Section 7 stipulates that “All Bills for raising Revenue shall originate in the House of Representatives” and because since the Speaker of the House is the person charged with the most fiduciary responsibilities in the nation, determining the $6.2Trillion budget and growing, it is of paramount concern to ensure that this office holder does not omit, conceal, or falsify relevant facts of personal history and to ensure that all questions related to trustworthiness are addressed. Since questions of trustworthiness have not been addressed for the last 7 years, an untrustworthy officeholder of the Speaker’s Gavel becomes catastrophic for the national security and very existence of the nation.

(b) deliberately providing false or misleading information; or concealing or omitting information, concerning relevant facts to an employer, investigator, security official, involved in making a recommendation relevant to a national security eligibility determination, or other official government representative;

On numerous occasions, Kevin McCarthy has deliberately provided false and misleading information through the concealment of relevant facts, as it relates to his bid for the Speakership in 2015 and the transgressions that forced him from that position, as well as concealing and omitting relevant information as it relates to his conversations with Liz Cheney, an individual actively pursuing the destruction of our Constitutional order along with her mentor Mike Pence.

(c) credible adverse information in several adjudicative issue areas that is not sufficient for an adverse determination under any other single guideline, but which, when considered as a whole, supports a whole-person assessment of questionable judgment, untrustworthiness, unreliability, lack of candor, unwillingness to comply with rules and regulations, or other characteristics indicating that the individual may not properly safeguard classified or sensitive information;

In parts 1, 2, 3, and 4 of this Counterintelligence Investigation of Kevin McCarthy, we have outlined the numerous violations that put into question his ability to avoid blackmail based on transgressions in the following categories:

1 Allegiance to the United States

2 Foreign Influence

3 Foreign Preference

4 Sexual Activities

Additionally, the revelations of his lying and untrustworthiness amongst his respected colleagues in the House of Representatives bring more evidence to make an unfavorable determination as it applies to Guideline 5, Personal Conduct.

(d) credible adverse information that is not explicitly covered under any other guideline and may not be sufficient by itself for an adverse determination, but which, when combined with all available information, supports a whole-person assessment of questionable judgment, trustworthiness, unreliability, lack of candor, unwillingness to comply with rules and regulations, or other characteristics indicating that the individual may not properly safeguard classified or sensitive information. This includes, but is not limited to, consideration of:

(1) untrustworthy or unreliable behavior to include breach of confidentiality, release of proprietary information, unauthorized release of sensitive corporate or government protected information;

(2) any disruptive, violent, or other inappropriate behavior;

(3) a pattern of dishonesty or rule violations; and

Congressman Bob Good explains that there are senior members of the Republican party that do not trust Kevin McCarthy. Going as far as to say that a Chairman of a committee had told Congressman Good that he does not trust Kevin McCarthy.

(e) personal conduct, or concealment of information about one’s conduct, that creates a vulnerability to exploitation, manipulation, or duress by a foreign intelligence entity or other individual or group. Such conduct includes:

(1) engaging in activities which, if known, could affect the person’s personal, professional, or community standing;

(f) violation of a written or recorded commitment made by the individual; and

(g) association with persons involved in criminal activity.

Kevin McCarthy’s association with seditious conspirators: George W. Bush, Dick Cheney, Paul Ryan, Mike Pence, Nancy Pelosi, Chuck Schumer, Mitch McConnell, and General Mark Milley to effectuate a Coup d’etat on January 6, 2021, by usurping the Constitutional Authority that a sitting President of the United States of America had and instead unconstitutionally granting it to the Vice President to order the US military around without invoking the 25th Amendment, Section 4, made him a complicit actor in a criminal treasonous act.

Additionally, when Kevin McCarthy attended a dinner at the White House with the Chinese Communist Party’s Captured Illegitimate Ambassador to the U.S. Joseph R. Biden along with his son Hunter, whom he and his criminal syndicate family has been charged with 459 crimes, see Marco Polo USA report. As Kevin McCarthy rebuffs President Trump for having dinner with a Hispanic young man, black rapper, gay foreigner, and a woman exercising their First Amendment in his own home, McCarthy cavorts with an individual that has had inappropriate showers with his daughter, and a known agent of the Chinese Communist Party based on his 10% financial dealings with Chinese intelligence.

These are all crimes of the highest order and thus Kevin McCarthy’s association with these individuals clearly violates this adjudicative guideline. Additionally, as outlined in Parts 1-4 of this report, you can clearly see the alleged relationship that McCarthy has with executives of FTX, particularly Ryan Salame. Something that our investigative team is further looking into for financial crimes and campaign finance crimes.

VERDICT: Kevin McCarthy’s counterintelligence risk based on his Personal Conduct is a walking nuclear time bomb and will result in a catastrophic national security impact putting the nation at peril should he become the Speaker of the House.

National File can exclusively report that establishment-leaning members of the House Freedom Caucus are considering a compromise to make Kevin McCarthy the next Speaker of the House; a compromise that involves keeping Nancy Pelosi’s rules, while adding a watered-down version of the crucial motion to vacate the chair.

Under the compromise being considered by some Freedom Caucus members, to come over to the side of establishment leader Kevin McCarthy, a two-thirds majority will be required to “vacate” the position of Speaker.

Before the crucial motion was effectively killed by Nancy Pelosi, making the Speaker of the House all-powerful and requiring party leadership to initiate the motion to vacate, any member of Congress could challenge the Speaker’s power and a simple majority of votes could end a speakership.

In 2015, then-Freedom Caucus Rep. Mark Meadows did just that, kicking off the chain of events that led to the end of GOP’er John Boehner’s congressional career.

That same year, Kevin McCarthy launched his first bid for the speakership, in an effort to fill the void left by Boehner, but was forced to exit from the gavel race after ethics questions were raised about his relationship with a female GOP legislator.

He then backed his longtime associate, Paul Ryan, who went on to serve as Speaker during the first half of President Trump’s first term in office, stymying the America First agenda at every turn.

Returning the motion to vacate to its rightful position in the House rules has been a point of contention between McCarthy, his supporters, and the House Freedom Caucus, several members of which have vowed not to support McCarthy’s speakership campaign under any circumstances.

As reported by National File, Kevin McCarthy has refused to commit to getting rid of any of Nancy Pelosi’s left-wing House rules when challenged on the issue.

Though he’s already calling himself “Speaker-elect,” McCarthy doesn’t have the 218 votes he needs to secure the speakership and is facing a challenge from conservative Freedom Caucus Rep. Andy Biggs.

In an apparent effort to drum up support for their chosen Speaker, corporate news outlets have cozied up to McCarthy, but his conservative opponents won’t go away.

Multiple Freedom Caucus Reps. have vowed not to vote for McCarthy, under any circumstances, and that list appears to be growing. If so, McCarthy will find it impossible to become Speaker of the House without significant Democrat support.

Sexual behavior that involves a criminal offense; reflects a lack of judgment or discretion; or may subject the individual to undue influence of coercion, exploitation, or duress. These issues, together or individually, may raise questions about an individual’s judgment, reliability, trustworthiness, and ability to protect classified or sensitive information.

In the case of Kevin McCarthy, his own sexual behavior has already stopped him from becoming Speaker of the House once before, when in 2015, he was forced to step down from Speaker contention when an alleged affair he was having with female GOP Rep. Renee Ellmers hit the headlines.

Among those at the forefront of stopping McCarthy and his alleged affair baggage from getting the gavel were members of his own party.

“any candidate for Speaker of the House, majority leader, and majority whip withdraw himself from the leadership election if there are any misdeeds he has committed since joining Congress that will embarrass himself, the Republican conference, and the House of Representatives if they become public.” Rep. Walter Jones R-NC, email just before Kevin McCarthy withdrew from the Speaker of the House race in 2015.

That was part of it. … It was a combination of different things that have happened over the years and this was one of them” referring to the alleged affair between Kevin McCarthy and Renee Ellmers.

Conditions that could raise a security concern and may be disqualifying include:

(a) sexual behavior that causes an individual to be vulnerable to coercion, exploitation, or duress; and

As was the case with failed Speaker candidate Congressman Bob Livingston in 1998, and Kevin McCarthy in 2015, because McCarthy has yet to address the affairs in the past, and likely new ones since 2015, he has a tendency to be susceptible to coercion exploitation, and duress.

This was evidenced when he stepped out of the Speaker’s race in 2015 and when he was coerced by something as trivial as a conversation that Lizzie Cheney recorded of Kevin discussing that he would ask President Trump to resign.

(b) sexual behavior of a public nature or that reflects a lack of discretion or judgment:

Close colleagues of Kevin McCarthy describe him as a person where “There are no red lines, core policy beliefs, or inviolable principles”. “McCarthy played both sides.” Thus in his quest for the Speaker’s gavel, he will likely violate moral, ethical, and likely legal norms to ensure his ascendency to the Speakership. Once there, it will be too late for the Nation to recover from such a grave national security threat after the top 3 Federal officials are subject to blackmail, foreign capture, and a plethora of other points of blackmail and leverage by interests anathema to US Constitutional principles.
